3. Payments & Refunds
All services, once commenced or work has begun, are non-refundable unless otherwise stated in a written agreement. Deposits, retainers, and setup fees are non-refundable.
Work will not begin until required payment terms are satisfied.
4. Client Responsibilities
Clients must provide necessary access, information, and cooperation required to perform contracted services. Failure to do so may delay or impact service delivery without refund entitlement.
5. Intellectual Property
All content, designs, systems, code, marketing assets, and other deliverables created by Hawk Digital Systems remain the intellectual property of the Company unless otherwise agreed in writing. Licensed use may be granted for client operations upon full payment.
6. Limitation of Liability
Hawk Digital Systems is not liable for direct, indirect, incidental, consequential, or punitive damages arising from use of our website or services. No outcome, ranking position, or specific business result is guaranteed unless explicitly documented in writing.
7. Termination
We reserve the right to deny service or terminate engagement for violation of these Terms or for misuse of platforms or communication channels.
8. Third-Party Tools & Integrations
We may integrate with third-party platforms such as Google, Facebook, hosting providers, software tools, and CRM systems. We are not responsible for functionality or changes within external services.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado.

11. SMS Communications & Consent
Program. Hawk Digital Systems sends text messages to people who ask about our marketing services. If you check a consent box on our website form, you agree to receive text messages from Hawk Digital Systems at the number you provided. Checking a box is optional. You can submit the form without agreeing to texts.
What we send. If you check the non-marketing box, we text you about your inquiry, appointment confirmations and reminders, and customer care. If you check the marketing box, we may also text you offers, free audit invitations, and updates about our services.
Frequency and cost. Message frequency varies. Message and data rates may apply.
